When a client buys a house, the smart ones will always ask for a building and pest inspection clause “Conditional upon a Building Pest Inspection” but most people don’t realise that this clause means nothing leaving the real estate buyers to the mercy of the real estate agents and vendors.

What are building and pest conditions?
A building and pest condition clause should exist as a condition of the sale when you buy a property in Melbourne. The clause allows you to get written reports from qualified building and pest inspectors to ascertain if there are any major, structural building defects or termite infestations within the property.

A correctly worded building and pest clause may give you the right to withdraw from the contract if the report comes back showing that there is a major structural defect and or the existence of termites or termite infestations.

– Defects to stumps especially timber stumps that may be rotten

– No insulation installed to the roof void
– Retaining walls that have not been built correctly
– Electrical problems to the switchboard

They know that there are very few properties that have structural defects but many have building inspection defects that are classified as major so, the buyer cannot rescind the contract or negotiate.

There may be major defects that could cost many thousands to rectify and the poor house buyer is stuck with nowhere to go “Buyer Beware”

Conduct Building Pest Inspection BEFORE signing the building contract.

I always advise my clients to conduct a Pre Purchase Building Inspection before signing the contract as this will protect the purchaser more so than the clause “Conditional Upon a Building Pest Inspection” inserted into the building contract.

Unfortunately, most agents will push the purchaser to sign the contract with this clause inserted telling them they are protected when in fact most purchasers are not.

We recently conducted a pre purchase building inspection for a client only to find that the property had timber stumps throughout, which had severe decay and were causing the flooring above to be out of level by 35mm at some sections, the property required immediate replacement of stumps with a rectification cost of $23,000.
